Terms of Use
Version 0.2
Working draft.
1. About Sage
Sage is a wellbeing application designed to support reflection, relaxation, mindfulness, breathwork, movement, meditation, Check-In, and general wellbeing. Check-In may include selected emotions, intensity, and short written descriptions or contextual notes you choose to provide about how you are feeling.
Sage may use artificial intelligence to provide personalised reflections, suggestions, and wellbeing content based on information voluntarily provided by users.
Sage is a wellness product. It is not a medical service, psychological service, counselling service, or emergency service.
2. Agreement to these Terms
By creating an account, accessing Sage, or using any Sage feature, you agree to these Terms of Use and our Privacy Policy.
If you do not agree with these Terms, you should not use Sage.
If you download Sage from the Apple App Store, these Terms sit alongside Apple’s standard Licensed Application End User License Agreement. They do not replace it.
3. Eligibility
Sage is currently intended for adults aged 18 years and over. Users must have the legal capacity to agree to these Terms.
Sage should not be used by children unless and until Sage introduces specific age-appropriate functionality, consent processes, and privacy protections.
4. Wellness, not medical care
Sage provides general wellbeing information and experiences only. Nothing provided by Sage should be interpreted as medical advice, psychological or psychiatric diagnosis, treatment, counselling, physiotherapy advice, nutritional treatment, emergency intervention, or a substitute for professional healthcare.
Sage does not diagnose, prevent, cure, or treat any medical or mental health condition. Users should obtain advice from an appropriately qualified healthcare professional where necessary. Do not delay seeking professional care because of information provided by Sage.
5. Artificial intelligence
Certain Sage features may use artificial intelligence, including Check-In reflections, personalised wellbeing suggestions, reflections based on short written Check-In responses, generated prompts, and recommendations between activities.
AI-generated information can be incomplete, inappropriate, outdated, or incorrect. Sage does not guarantee that an AI-generated response will be accurate, appropriate, or suitable for a user’s circumstances.
Users remain responsible for decisions they make after using Sage. AI outputs must not be relied upon for medical, legal, financial, emergency, or other professional decisions.
5.1 Emotional support
Sage may discuss emotions, stress, mood, and personal experiences. This does not make Sage a therapist or counsellor. Sage cannot provide clinical assessment or determine whether a user has a mental health condition.
6. Emergencies and crisis situations
Sage is not designed for emergencies or crisis intervention. If a user believes they or another person may be in immediate danger, they should contact the appropriate emergency service or qualified professional.
Sage should not be relied upon to detect or prevent self-harm, suicide, violence, or other emergencies. Where Sage detects language that may indicate an immediate safety concern, Sage may interrupt its ordinary wellbeing experience and encourage the user to seek appropriate human support. No automated system can detect every emergency accurately. Sage does not contact emergency services for you, and Sage does not monitor you.
7. Breathwork safety
Some Sage activities involve deliberate changes to breathing patterns. These exercises can cause light-headedness, tingling, dizziness, temporary changes in perception, breathlessness, or emotional responses. Users should stop immediately if they feel unsafe, severely uncomfortable, or unwell.
7.1 Deep Breath Reset
The Deep Breath Reset may include repeated deeper or faster breathing followed by slower breathing or breath retention. Users must perform it only in a safe environment.
Never perform intensive breathwork:
- while driving
- while operating machinery
- in or near water
- while swimming
- in a bath or shower
- at heights
- while standing where fainting could cause injury
- during an activity requiring full attention
Where appropriate, remain seated or lying somewhere safe.
7.2 Medical considerations
Obtain medical advice before intensive breathwork if you have a cardiovascular or respiratory condition, a history of fainting, a seizure disorder, are pregnant, recently underwent significant surgery, have another condition that may make altered breathing or retention unsafe, or have been advised to avoid intensive breathwork.
This list is not exhaustive. If unsure, do not undertake intensive breathwork until professional advice has been obtained.
8. Cold exposure
Cold exposure can involve physical risk. Participation is voluntary and at the user’s own risk. It should be gradual, controlled, and performed in a safe environment.
Stop immediately for severe discomfort, confusion, loss of coordination, chest pain, breathing difficulty, or another concerning symptom. Obtain professional advice if an existing condition may make cold exposure unsafe. Sage does not encourage extreme cold exposure. Never combine breath-holding or intensive breathwork with water immersion.
9. Movement and physical activity
Movement activities are general wellbeing exercises. Work within your capabilities, use suitable space and equipment, stop for pain, dizziness, or unusual symptoms, and seek professional advice where injury, illness, or limitation may affect safe participation. Sage cannot assess a user’s physical condition remotely.
10. Guided and Silent Journeys
Guided Journeys and Silent Journeys are relaxation and mindfulness experiences. They are not intended to induce hypnosis, diagnose conditions, or provide psychological treatment.
Participate only where it is safe to reduce attention to surroundings. Do not use journeys while driving, cycling, operating machinery, or performing another activity requiring full attention.
11. Personal responsibility
Users are responsible for deciding whether an activity is suitable for them. Participation in breathwork, movement, cold exposure, or other physical practices is voluntary.
Nothing in these Terms excludes rights or protections that cannot legally be excluded under applicable Australian law.
12. Accounts and security
Users must provide accurate account information, protect access to the email used to sign in, maintain control of their devices, and notify Sage if their account may be compromised.
Users must not:
- access another person’s account
- interfere with Sage systems
- reverse engineer Sage where prohibited by law
- use Sage for illegal activity
- abuse or deliberately manipulate AI systems
- upload material they do not have the right to use
13. Subscriptions and payments
Prices and billing terms will be displayed before purchase. Purchases through the Apple App Store or Google Play Store may also be subject to the applicable platform’s billing, renewal, cancellation, and refund terms. Automatic renewal must be clearly disclosed before purchase.
Sage Premium is offered by subscription and may include a limited introductory trial. Purchases are processed by Apple or Google through RevenueCat. Sage does not receive your full payment card number. Managing or cancelling a subscription does not, by itself, delete your Sage account or Check-In data.
Users retain rights under the Australian Consumer Law. Nothing excludes, restricts, or modifies consumer guarantees or other rights that cannot legally be excluded.
14. Intellectual property
Unless stated otherwise, Sage owns or licenses its branding, software, original written content, journey scripts, visual assets, sound design, user interface, original audio, illustrations, and product copy.
Users receive a limited personal right to use Sage for its intended purpose. Content may not be commercially copied, resold, distributed, or republished without permission.
Short written Check-In responses and other content you enter remain yours. You allow Sage to host and process that content as needed to provide the service, including generating reflections, as described in the Privacy Policy.
15. Third-party services
Sage may rely on third parties for cloud infrastructure, authentication, AI, payments, and app distribution. Their availability may be outside Sage’s control.
Providers currently used to operate Sage include Supabase (accounts, database, authentication email, and server functions), OpenAI (AI reflections and suggestions), RevenueCat (subscription status), Apple (App Store billing and iOS services), Google (Google Play billing, if you use Android), and Expo (the app runtime and local notifications on your device). Sage does not currently use a separate analytics or crash-reporting provider.
Where providers receive personal information, Sage will manage disclosures in accordance with its Privacy Policy and applicable law.
16. Availability and product changes
Sage may be unavailable because of maintenance, faults, network problems, third-party outages, or updates, and does not guarantee uninterrupted availability.
Sage may add, modify, or discontinue features. Where a change materially affects legal rights or personal-information handling, appropriate notice will be given where required.
17. Limitation of liability
To the maximum extent permitted by law, Sage is not liable for loss arising solely from reliance on general wellbeing information or AI-generated content where it was not intended as professional advice.
Nothing excludes or limits liability where doing so would be unlawful, including applicable Australian Consumer Law rights.
18. Termination
Users may stop using Sage at any time. Sage may suspend or terminate accounts where reasonably necessary for serious breaches, fraud, security risks, unlawful use, or abuse of infrastructure.
Account and personal-information deletion are addressed separately in the Privacy Policy.
19. Governing law and contact
These Terms are governed by the laws applicable in South Australia, Australia, subject to mandatory laws applying elsewhere.
